Privacy Policy NightP.com (India)

Effective Date: 1st, July 2025.


Entity: NightP Escort Services, (“NightP”, “we”, “us”, “our”)
Scope: This Policy applies to visitors, registered users, and advertisers who access or use NightP.com and related services (collectively, the “Platform”).


1) Legal Basis & Applicability

We process personal data in compliance with the Digital Personal Data Protection Act, 2023 (DPDPA), the Information Technology Act, 2000, the IT (Reasonable Security Practices & Procedures and Sensitive Personal Data or Information) Rules, 2011 (SPDI Rules), and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. NightP operates as an online classifieds intermediary; we do not employ, control, or manage advertisers, and we are not a party to any offline engagement.


2) What We Collect (Categories)

From visitors/browsers: IP address, device IDs, user agent, timestamps, pages viewed, referral URLs, coarse location, cookies/SDK events, and security logs.
From account holders/advertisers (as provided by you): name/alias, email, mobile number/WhatsApp, profile photos, listing content and metadata (areas, languages, rates, availability), identity/age proof if requested for verification (masked/hashed where feasible), communication preferences, and payment metadata (transaction ID, status no full card details stored).

From support/grievances: messages, attachments, reporter contact details, and action logs.


3) Purpose Limitation (Why We Use It)

We collect and use data only for specific purposes:

  • Account creation, authentication (OTP), and ad publishing/management.
  • Safety, fraud-prevention, spam control, and enforcement of our Terms and Content Policy.
  • Payments, invoicing, refunds, and statutory accounting.
  • Analytics, service improvement, A/B tests, and debugging.
  • Customer support, grievance redressal, and legal compliance (including takedown orders).
  • Security incident detection and prevention (rate limiting, abuse detection, logs).

Processing is primarily based on consent (DPDPA) and, where applicable, on legitimate uses permitted by law (e.g., fraud prevention, legal claims, and compliance).


4) Cookies & Tracking

We use essential cookies (session, security), functional cookies (preferences), and analytics (e.g., Google Analytics). You can manage non-essential cookies via our banner/settings; essential cookies are required for the Platform to function. We do not respond to browser “Do Not Track” signals at this time.


5) Disclosures (Who We Share With)

We do not sell personal data. We share limited data with:

  • Processors/Service Providers: hosting/CDN, cloud storage, analytics, payment gateways, SMS/email/OTP providers, image moderation/abuse-prevention tools, and KYC/verification partners (if enabled).
  • Legal/Regulatory: law-enforcement or government agencies upon valid legal request or to protect our rights, users, or the public.
  • Business Transfers: in a merger, acquisition, or asset sale, with continued protection under this Policy.

All processors are bound by contracts that require adequate security and use only for our documented purposes.


6) Cross-Border Transfers

Your data may be processed on servers located inside or outside India. Where transferred, we use contractual safeguards and transfer only to jurisdictions not restricted under the DPDPA and with protections comparable to this Policy.


7) Security Measures

We implement reasonable and appropriate controls including TLS encryption in transit, restricted access on a need-to-know basis, role-based permissions, audit logs, hardened cloud infrastructure, periodic backups, and vulnerability patching. No method is 100% secure; please share information responsibly.


8) Data Retention

  • Account and listing data: while your account is active and for up to [24 months] after last activity, unless earlier deletion is requested or longer retention is required by law.
  • Transaction/tax records: retained up to [8 years] or as required by statute.
  • Takedown/termination logs: retained for at least 180 days in line with Intermediary Guidelines.
    When retention ends, we delete or de-identify data per our internal schedule.

9) Your Rights (DPDPA)

Subject to applicable law, you may:

  • Access the data we hold about you.
  • Correction/Completion of inaccurate or incomplete data.
  • Erasure (“right to be forgotten”) where processing is no longer necessary or consent is withdrawn.
  • Consent management: give or withdraw consent at any time (withdrawal will not affect prior processing; certain services may stop working).
  • Grievance & Appeal: escalate unresolved issues to our Grievance Officer; you may further approach the Data Protection Board of India if dissatisfied.

How to exercise your rights

Email support@nightp.com or use Account → Privacy Settings with proof of identity. We will acknowledge within 24 hours and aim to resolve within 15 working days (or as mandated by law).


10) Minors (Under 18)

The Platform is 18+ only or we may recommend you age should be more than 22 years,

 We do not knowingly collect data from minors. If we discover a minor’s account/ad, we will promptly delete the data and disable access. Report such cases to support@nightp.com.


11) Intermediary & User-Generated Content

NightP is an intermediary under the IT Act. Advertisers are solely responsible for their content and claims. We provide notice-and-takedown and cooperate with lawful orders. Content that is illegal, non-consensual, misleading, or violates our policies may be removed and accounts restricted or banned.

We acknowledge complaints within 24 hours and target resolution within 15 days.


13) Changes to This Policy

We may update this Policy to reflect legal, operational, or technological changes. Material updates will be notified on the Platform and become effective on posting unless stated otherwise.
